Ryze & Shine Terms and Conditions

By installing and using the Ryze & Shine mobile application, you agree to the following Terms and Conditions

The following terminology applies to these Terms and Conditions: “User”, “You” and “Your” refers to you, the person using this app and compliant to the Company’s terms and conditions. “Developers”, “Ourselves”, “We”, “Our” and “Us”, refers to ‘Mighty Bear Vibes’ and associated developer(s) for the ‘Ryze & Shine’ mobile app as registered with Google Play Developer Console. “App” refers to the ‘Ryze & Shine’ mobile application/software to which these terms apply. By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. If you do not agree with this Terms and Conditions, do not install or use the App

License, copyright and ownership

You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights, contents, all types of media, colors, designs, UI elements and other intellectual property rights related to it, belong to the developers.

Liabilities & Responsibilities

The developers are committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

Internet and usage

You should be aware that there are certain things that the developers will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but the developers cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, the developers cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, the developers cannot accept responsibility.

Data removal

We do not back up any of your data on our servers. We provide a service that enables you to back up your data to your chosen Google Drive account. So please take note that if you do uninstall the app, your data will be removed and cannot be recovered.

App updates

At some point, we may wish to update the app. The app is currently available on Android – the requirements for system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the system and app updates if you want to keep using the app. The developers do not promise that they will always maintain the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you.

Responsibilities

It is your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the app won’t work properly or at all.

We recommend that you do not enter into the app any private, secret or personally identifiable data in this mobile application including but not limited to, passwords, name, email addresses, location information, credit card details or important financial information. As we do not store, process or have access to your data, the App, it’s developers or any related parties are not liable for information loss, modification and theft of your data that is stored locally in your device.

Privacy and User Data

The app does not store your personal data that you have provided to us. All your data is stored in your mobile phone or device in which the app is installed. Upon uninstallation, all data will be removed along with the app.

We do rely on third parties to provide information to us so that we can make it available to you. These services that declare their own Terms and Conditions.

Purchases

The app and its services may be accessed and used in the following ways:

  1. Free version: Limited features and services that are free always
  2. Premium versions (monthly and yearly): All existing and future features & services of the app so long as the app is available

Premium Version:

Premium entitles you to all features provided in the app along with the removal of display advertising.

Premium is purchased through the Google Play store, and we will not provide a refund. Your purchase will be subject to Google’s applicable payment policy, which also may not provide for refunds. Should the app and it’s services be terminated, your payment will not be refunded and you may continue to use the app in your current device where the app is already installed.

In the event that you change your device, you may restore your purchase by visiting the “Premium” page on the app and it will be automatically restored.

Premium version types:

The app offers monthly and yearly(annual) subscriptions

Monthly subscriptions (30 days):

  • The monthly subscription fees be billed to the Payment Method you provided, automatically until it is cancelled via the Google Play Store. You must cancel your subscription before it renews each month in order to avoid billing of the next month’s subscription fee to the Payment Method you provided. Refunds will not be granted for partial month usages.
  • The monthly subscription fees be billed to the Payment Method you provided, automatically until it is cancelled via the Google Play Store. You must cancel your subscription before it renews each year in order to avoid billing of the next year’s subscription fee to the Payment Method you provided. Refunds will not be granted for partial year usages.

Termination of the App and Services

We may also wish to stop providing the app and its services at any time without giving notice of termination to you. You may continue to use the application in your current device where the app is already install. However upon termination, any other services, updates and downloads along with support will be terminated as well.

Changes to this agreement

The developers may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.

These terms and conditions are effective as of 2nd September 2020
